DETROIT (WXYZ) - Former Grosse Pointe businessman and Rotary Club president Bob Bashara is now facing murder charges in the death of his wife Jane.

Wayne County Prosecutor Kym Worthy, flanked by other law enforcement officials, made the announcement at a news conference Wednesday.

Bashara was charged with first degree murder, conspiracy to commit first degree murder, solicitation to commit murder, suborning of perjury during a capital trial, witness intimidation and Obstruction of justice.

It was one year and three months ago that Jane Bashara’s body was found inside her SUV in an alley on Detroit's east side.

So what’s taken so long?

Worthy says it’s a complicated case that stretched across several states and included three hundred witnesses and five thousand documents.

"We are living in a TV kind of era when you thing everything is wrapped up in 44 minutes. And that's just not the way it happens," Worthy said.

The prosecutor also revealed that Bashara himself delayed their investigation and that resulted in some of the charges.

"We are alleging that he encouraged witnesses to call in false tips. We are alleging that he tried to get a witness or witnesses to leave the state so they could not be talked to. And we are alleging that he was, again, encouraging witnesses to lie to us during the pendency of this investigation," Worthy told reporters.

A source close to the case tells the 7 Action News Investigators Bashara's former mistress, Rachael Gillett was the witness he allegedly pressured to move out of state and the witness intimidation charge involves her and handyman Joe Gentz.

Gentz admitted to killing Jane Bashara under Bob Bashara’s direction and is serving seventeen to twenty eight years in prison, with an agreement to testify against Bashara.

Some legal observers say Gentz credibility will be a problem because he has a low I-Q and gave different accounts of what happened to police.

Worthy says she doesn't consider Gentz a star witness.

"He's a strong witness for us. He's a credible witness we think for us but certainly all of the witnesses in the case make up the case together," said Worthy.

Worthy refuses to talk about any details of their case and the court file has been sealed making it off limits to reporters.

Bashara is expected to be brought to Detroit next week for arraignment. Bob Bashara is currently serving a prison sentence for trying to hire a hit man to kill Gentz.

Worthy said everything will come out in the preliminary examination and wouldn’t discuss whether there is DNA evidence or how Jane Bashara’s family responded to the news.

She would not discuss motive and called it a “different” case based on the size and scope of the investigation.

“I’m going to keep my opinions about him to myself,” said Worthy when asked about her interpretation of Bashara’s character. “He was always a person of interest.”

More than 14 months after his wife, Jane, was killed, Robert “Bob” Bashara was charged Wednesday with first-degree, premeditated murder for her death.

Wayne County Prosecutor Kym Worthy, surrounded by law enforcement officials and a media throng, announced the long-awaited charges in a press conference in her offices on the 12th floor of the Frank Murphy Hall of Justice in Detroit.

Bashara, 55, who is in prison for trying to have a key witness in the case killed, is expected to be formally arraigned next week in 36th District Court in Detroit.

In addition to first-degree murder, punishable by life in prison without parole, he is charged with conspiracy to commit first-degree murder, solicitation to commit murder, subverting of perjury during a capital trial, witness intimidation and obstruction of justice.

Bob Bashara will be arriagned on several charges next week in the strangulation death of his wife Jane Bashara following an investigation spanning multiple states and nearly 300 witnesses.

Wayne County Prosecutor Kym Worthy announced several charges early Wednesday against Bashara. She was surrounded by more than a dozen people from various agencies who helped in the investigation and without, Worthy said, charges never would have resulted.

The charges include:

• first degree murder
• conspiracy to commit first degree murder
• solicitation to commit murder
• suborning of perjury during a capital trial
• witness intimidation
• obstruction of justice

Bashara is currently serving a prison sentence on a second, related case involving his former handyman, Joe Gentz, whom he tried to have killed while in jail to prevent him from testifying. Bashara is currently being housed in Manistee in Oaks Correctional Facility.

He will be brought from prison to Wayne County's 36th District Court next week to make his first appearance on the charges announced Wednesday.

Prosecutor Kym Worthy said the case took one year and three months to file charges because of its complexity. The investigation spanned seven states, including Michigan, Iowa, Kentucky, Illinois, Florida, Oregon and Texas, she said.

It also involves nearly 300 witnesses, many computers and cell phones, all of which were forensically analyzed, and a variety of tips that were tracked down by investigators. Additionally, Worthy said there were more than 5,000 pages of documents that had to be reviewed during the investigation.

Worthy described Gentz as a "strong witness" but not the only witness. She said there are many witnesses. Gentz agreed to testify against others if additional charges came forth as part of his plea agreement in his own case. He turned himself into police in the days after Jane's body was found, saying her husband hired him to kill her for money. He is serving a 17 to 28 year prison sentence.

The investigation began in January 2012 when Jane Bashara's body was found in the back of her SUV in a Detroit residential alley near 7 Mile and Hoover, which is approximately 20 minutes north/northwest of her home in Grosse Pointe Park.

Bob Bashara was named a "person of interest" in the days after her body was found and as the investigation evolved, Gentz was charged with murder and conspiracy in March 2012. Then, three months later on the five month anniversary of Jane's death, Bob Bashara was arrested outside a prominent Grosse Pointe Park restaurant for hiring a hitman to kill Gentz while he was housed in jail awaiting trial and going through psychological evaluations to determine his competency to stand trial.

Jane Bashara was a marketing executive who volunteered much of her free time in the community. The couple was well known within the Pointes and were recognized several years ago by the Grosse Pointe Public School board for dedication to volunteering. Her violent death was unsettling to a small community where everyone knows each other.

Bashara faces mandatory life in prison on the first degree murder charge; up to life on each the conspiracy, solicitation and suborning counts; 15 years for witness intimidation; and five years for obstruction of justice.

Worthy provided general examples during the 20 minute press conference in her office Wednesday. Among them, she said, Bashara tried to get at least one witness to move out of state so investigators could not talk to him or her.

She declined to answer specific questions about where the crime happened, whether any DNA evidence is part of the case and Bob Bashara's motive to kill his wife.

Worthy was surrounded by more than a dozen individuals Wednesday whom without she said the charges never would have happened. Worthy had each person introduce themselves and identify the agency with which they are associated. Among the group were representatives of the Grosse Pointe Park Public Safety Department, Michigan State Poice, FBI, the Bureau of Alcohol Tobacco and Firearms, Detroit Police and the Wayne County Prosecutor's Office.

Additionally, Worthy said the investigation involved other law enforcement agencies including Chicago, the Cook County Prosecutor's Office, Livonia and Roseville police departments, Fort Lauderdale Police, the Michigan Department of Corrections and one publication, the Lexington Post.

In discussing the length of time it took to file charges, Worthy said waiting until all of the information is in order is the more responsible and efficient way to handle such cases. It prevents time delays during the actual prosecution and trial phase of the case, which is a waste of time and money for everyone, including witnesses.

Already imprisoned for six to 20 years for admitting he hired someone to kill handyman Joseph Gentz, Robert Bashara is now looking at possibly spending the rest of his life behind bars for allegedly orchestrating his wife’s murder.

During a press conference April 17 inside the Wayne County Prosecutor’s Office at the Frank Murphy Hall of Justice, Wayne County Prosecutor Kym L. Worthy announced that Bashara, 55, of Grosse Pointe Park, had been charged with first-degree murder, conspiracy to commit first-degree murder, solicitation to commit murder, suborning of perjury during a capital trial, witness intimidation and obstruction of justice.

The first charge carries a sentence of mandatory life in prison without parole, while the next three charges carry a possible sentence of life or any number of years in prison. Witness intimidation carries a possible 15-year sentence, and obstruction of justice carries a five-year sentence.

The charges come a year and nearly three months after Jane Bashara was killed. Her family learned of the charges shortly before the press conference the morning of April 17, Worthy said.

Worthy said they wanted to undertake a thorough investigation before proceeding with charges against Robert Bashara.

“We are living in a TV era where everything is wrapped up in 44 minutes,” Worthy said. “That’s just not the way it happens (in real life).”

If the case goes to trial, Wayne County prosecuting attorneys Robert Moran — chief of special investigations — and Lisa Lindsey — lead prosecuting attorney — will be handling it inside the courtroom, Worthy said. Worthy declined comment on specifics of the case, including whether investigators had recovered DNA evidence or whether the clothes Jane Bashara was wearing at the time of her murder had been lost or destroyed, as had been reported previously.

Jane Bashara, 56, was said to have been murdered Jan. 24, 2012, at the Grosse Pointe Park home in the 500 block of Middlesex where she lived with her husband. Police said Robert Bashara called them at around 11:35 p.m. Jan. 24 to report his wife missing. Her body was discovered inside her abandoned SUV in an alley on Detroit’s east side, in the 19400 block of Annott, the next morning. On Jan. 31, 2012, handyman Gentz, 49, of Grosse Pointe Park, told investigators that Robert Bashara paid him to kill Bashara’s wife, and also that Bashara threatened Gentz if he didn’t go through with the murder. On Dec. 21, Gentz pleaded guilty to second-degree murder, and is now serving 17-28 years in prison for the crime.

Robert Bashara, who tried to hire someone to have Gentz killed, is also behind bars, having pleaded guilty Oct. 11 to a solicitation of murder charge in the Gentz plot.

Surrounded by investigators from Grosse Pointe Park, the Detroit Police Department, ATF, FBI, Michigan State Police, the Wayne County Prosecutor’s Office’s Criminal Investigation Bureau and elsewhere, as well as Lindsey and Moran, Worthy praised the collective effort of the investigative team assembled to work on this. She said 15 agencies — including some in other states — collaborated on an investigation that involved trips to Iowa, Illinois, Florida, Oregon and Texas, the interviewing of more than 200 witnesses, and the accumulation of roughly 5,000 pages of documents. Computers were forensically analyzed, as well, she said.

Worthy said at least one of the witnesses was asked by Bashara to leave Michigan to make it more difficult for investigators to interview that person.

“We are alleging that he was encouraging witnesses to lie under oath,” she said.

Worthy said Bashara also reportedly urged witnesses to call in false tips to throw off the investigation, which was part of the witness intimidation charge.

The case — whose twists have included Robert Bashara’s alleged involvement in the S&M world, the presence of at least one mistress, and the attempt to have Gentz killed — has garnered national media attention.

“I don’t know that I would use the word ‘strange’ (to describe the case),” Worthy told reporters in response to a question. “I would use the word ‘different.’ And certainly (it has) a lot of tentacles.”

As part of a deal in which Gentz pleaded guilty to second-degree murder for killing Jane Bashara, Gentz agreed to testify truthfully in any future court proceedings. His story to police last year is said to have changed several times, and Gentz is said to have an IQ in the range of 69 to the low 70s, leading some to speculate about his credibility as a witness. However, prosecutors are confident he’ll provide compelling testimony if the case goes to trial.

“We feel he’s going to be a very strong witness for us,” Worthy said of Gentz.

Worthy said she didn’t expect to be charging anyone else in this case.

“I’m confident that this concludes our investigation,” she said.

The Jane Bashara murder last January was the first in decades in Grosse Pointe Park, and law enforcement officials there are relieved to see that it might finally be coming to a close.

“This case is one we do not often experience in Grosse Pointe Park,” Public Safety Chief David Hiller said in a prepared statement. “I am grateful to the Wayne County Prosecutor’s Office and to all of the numerous agencies whose assistance was invaluable in this investigation. I also want to thank the members of my department for all of the hard work they have put into this case. The charging of Robert Bashara means that there will finally be justice for Jane Bashara and her family.”

Bashara is being transferred from a Michigan Corrections Department facility to 36th District Court, Worthy said. At press time, the family home where the murder is believed to have occurred — a five-bedroom colonial — was listed online for sale at $399,000, a reduction from the original asking price.

Although a date for Bashara’s arraignment hadn’t been set at press time, Worthy said it would likely be scheduled during the week of April 22. She said it’s not known how long a trial might last, how many witnesses could be called to testify, or whether any of those witnesses might be members of the Bashara family.

Bashara has repeatedly insisted he didn't have anything to do with his wife's murder.

Bob Bashara is expected to appear in a Detroit courtroom Wednesday to formally face allegations that killed his wife through a cohort.

Bashara will be charged with first-degree murder, solicitation of murder, suborning of perjury during a capital trial, witness intimidation and obstruction of justice in front of Magistrate Laura Echartea in 36th District Court in Detroit.

Bashara, 55, a former landlord, is accused of promising to pay and threatening his handyman, Joseph Gentz, to strangle his wife, Mount Clemens native Jane Bashara, 56, in January 2012 in the garage of their Grosse Pointe Park home.

Wayne County Prosecutor Kym Worthy announced the charges nearly two weeks ago and revealed some of the large volume of evidence her assistants will present at trial.

The 6 foot, 3 inch, 265-pound Bashara will be transported from a state prison for the hearing since he is already serving a sentence of 80 months to 20 years in prison for trying to have Gentz killed last June while Gentz was housed in the Wayne County Jail facility. For his role, Gentz, 49, pleaded guilty to second-degree murder last December and is serving a 17-to-28 year term. First-degree murder carries a mandatory penalty of life in prison without parole.

Magistrate Echartea is expected to schedule a district court preliminary examination at which the prosecution will be required to establish probable cause that a crime was committed and Bashara committed it, unless he and his attorney, Mark Kriger, decide to waive the hearing.

Criminal defense attorney Steve Kaplan, a former assistant prosecutor in Wayne and Macomb counties, said he expects Gentz to testify since he is the key witness in the case.

“You need him to meet the threshold,” Kaplan said, adding that prosecutors at trial will supplement his testimony with an excessive amount of corroboration evidence.

Kaplan said he expects minimal delays in the proceedings and a trial to be started by the end of the year. The trial itself could be lengthy – several weeks or more -- in part because the lead attorneys, Kriger and assistant Wayne prosecutor Lisa Lindsey, are meticulous trial attorneys.

Jane Bashara’s body was found in her Mercedes SUV parked in an east-side Detroit alley. Gentz, a former St. Clair Shores resident who is developmentally disabled, reportedly confessed to police about a week after the slaying and was arrested five weeks later.

Jane Bashara graduated from Mount Clemens High School. She most recently worked as a marketing manager for an energy consulting company in Detroit after working for Detroit Edison for 25 years.

Wayne County Prosecutor Kym Worthy’s officer announced Bashara’s appearance in a release issued Tuesday. He’s scheduled to appear before Magistrate Laura A. Echartea at 1:30 p.m. in 36th District Court in downtown Detroit. He also faces charges of conspiracy to commit first-degree murder, solicitation to commit murder, suborning of perjury during a capital trial, witness intimidation and obstruction of justice.

Bashara has been in a Manistee prison, sentenced to serve between 6½ and 20 years for trying to hire a hitman to kill handyman Joseph Gentz.

Bob asked for some more time .. said he needs to raise some funds ... for an attorney..

as he doesn't have an attorney..

He was there all by himself .. NO attorney was present!

Grosse Pointe Park businessman Bob Bashara was arraigned today on a first-degree murder charge in the death of his wife last year.

Bashara, who faces life in prison if convicted on that charge, also was arraigned in Detroit’s 36th District Court on multiple other charges, including solicitation to commit murder, witness intimidation and obstruction of justice in connection with Jane Bashara’s death in January 2012.

He is accused of intimidating witnesses, encouraging witnesses to lie under oath, encouraging people to call in fake tips and trying to have one witness leave the state, Wayne County Prosecutor Kym Worthy said last month when announcing the charges.

Bashara was in court today after being brought down from a Manistee prison, where he is serving about 6.5 to 20 years for trying to hire a hit man to kill Joseph Gentz – the man who told police he killed Jane Bashara at her husband’s behest.

Bashara said he does not currently have an attorney.

“At this point, I’m trying to raise funds for an attorney,” he said.

After the announcement of charges last month, attorney Mark Kriger, who previously represented Bashara, said Bashara denied involvement in his wife’s death.

Bob Bashara pleaded not guilty Wednesday to charges he's facing in connection with his wife's murder.

Bashara is facing a slew of charges, including first-degree murder, perjury, witness intimidation and conspiracy for the death of Jane.

During his arraignment, Bashara told the judge he was trying to raise funds to get an attorney. The judge told Bashara that if he didn't have one by his May 7 preliminary hearing, one would be appointed for him.

Bob Bashara's next court appearance is on May 7, 2013 at 1:30 p.m. at 36 District Court for preliminary examination.

If he can't afford an attorney, (sooner or later) one will be appointed for him.

Given the seriousness of charges --- there will be NO Bond for Bashara.

Therefore BB is to remain in custody.

"The court had previously informed our office that the defendant would be arraigned today, May 1, 2013, at 1:30 p.m. in 36th District Court," Maria Miller, a spokeswoman for Wayne County Prosecutor Kym L. Worthy, said in a statement Wednesday. "However, Magistrate Laura A. Echartea arraigned Bashara at 1 p.m. today."

Detroit — Robert Bashara appeared at his arraignment Wednesday and told a magistrate he is trying raise money to hire an attorney to defend him on charges that he killed his wife.

Bashara, wearing a blue prison uniform with the number 856261 stenciled on the back, stood with his hands folded before 36th District Court Magistrate Laura Echartea as she read the charges against him which include first degree murder and obstruction of justice in connection with the homicide of his wife Jane Bashara.

When told him that the preliminary exam is set for May 7, Bashara said "May I ask for more time? At this point I'm trying to raise funds for an attorney.

The magistrate denied his request for a delay and told him that if he hadn't hired an attorney by May 7 one will be appointed for him. No bond was given.

A not guilty plea was entered on behalf of Bob Bashara Wednesday in 36th District Court after he was arraigned on six charges related to his wife's strangulation death in January 2012.

Bashara is scheduled to return to court May 7 for a preliminary exam.

He is charged with:

• first degree murder
• conspiracy to commit first degree murder
• solicitation to commit murder
• suborning of perjury during a capital trial
• witness intimidation
• obstruction of justice

If convicted, Bashara faces mandatory life in prison on the first degree murder charge; up to life on each the conspiracy, solicitation and suborning counts; 15 years for witness intimidation; and five years for obstruction of justice.

Bashara requested to delay the preliminary exam date so he could have time to hire an attorney. Judge Laura A. Echartea declined to change the date from May 7, explaining if he has an attorney by then, his attorney can request to change the date.

He then said he had not yet hired one because he is trying to raise the funds to do so. Echartea responded by telling him if he hasn't hired one by then, an attorney will likely be appointed.

The arraignment, during which his charges were read to him, took less than five minutes.

Attorney Mark Kriger, who represented Bashara in his other criminal case related to trying to hire a hitman to kill Joe Gentz, was present at the hearing but did not address the court. Kriger said he had not been hired to represent Bashara in this case.

The courtroom gallery was filled with police officers, detectives and media. One Grosse Pointe Park detective, Mike Narduzzi, was present for the hearing Wednesday.

Bashara was escorted into the courtroom with heavy security, including a guard that stood within reach of him at all times. Bashara is currently serving a prison sentence related to his trying to hire a hitman to kill Gentz.

Gentz is also serving a prison sentence after he pleaded guilty in an agreement to testify against anyone the prosecutor's brought charges against in the case.

The investigation into Jane Bashara's death has been on-going since her body was discovered in January 2012. It involves nearly 300 witnesses and spans several states. Charges were announced against Bob Bashara by Wayne County Prosecutor Kym Worthy two weeks ago.

Bob Bashara was back in court Wednesday where he pleaded not guilty to a first degree murder charge, among others, in his wife's 2012 death. It's clear Bashara is worried about the battle ahead.

He is broke. Life certainly has taken a dramatic turn for the man who once live in a beautiful Grosse Pointe Park home.

The Bashara family's former home hit the market last month and at first real estate agents were not sure if anyone would be interested in a property that made national headlines for all the wrong reasons.

It turns out, the Grosse Pointe Park listing became one of the hottest in town. Dozens of people walked through the home on Middlesex Road and there were several offers. Local 4 has learned an offer has been accepted. The property is on the road to being sold but Bashara will not benefit. Even though the sale price was not far from the $399,000 asking price, it won't help "Big Bob."

In fact, Local 4 has learned Bashara, with help from those outside jail, has been working to unload many of his rental properties but several already have been taken over by the bank.

Bashara is fearful of working with a court-appointed attorney who is not familiar with his case.


Right after his wife Jane Bashara's murder, Bob hired high-profile attorney David Griem. That relationship fell apart last year and Bashara hired another top-notch attorney, Mark Krieger. Krieger was not by Bashara's side on Wednesday.

The attorneys aren't signing on for free and Bashara has a limited amount of time to come up with money before he assigned a new court-appointed attorney to take on his very detailed case.

Bob Bashara faces an Aug. 19 preliminary examination for the murder of his wife, Jane, in their Grosse Pointe Park garage.

The date for the probable-cause hearing was set Tuesday morning by Judge Kenneth King of 36th District Court in Detroit at a scheduling conference.

Bashara, who is in prison, did not attend the hearing but was represented by court-appointed attorney Mark Procida, who appeared. Also in attendance at the brief hearing was assistant Wayne County prosecutors Lisa Lindsey, Robert Moran and a third assistant prosecutor.

Procida said afterward the volume of the evidence in the case necessitated the three-month delay. Bashara waived his right to a preliminary examination within 14 days of his arraignment.

The case involves 15 law enforcement agencies in six states, nearly 300 witnesses and more than 5,000 pages of documents.

Bashara previously was represented by Mark Kriger, who could still be retained by Bashara.

Whether he hires another attorney is entirely up to him,” said Procida, a St. Clair Shores native.

Bashara, 55, was formally charged last Wednesday with first-degree murder, conspiracy to commit murder and solicitation of murder as well as charges related to the investigation -- suborning of perjury during a capital trial, witness intimidation and obstruction of justice.

Bashara allegedly paid and threatened Joe Gentz to strangle his 56-year-old wife in the garage of their Middlesex home. Jane Bashara’s body was found the next day, Jan. 25, 2012, in the back of her Mercedes SUV in an east-side Detroit alley.

Gentz, 48, formerly of St. Clair Shores, confessed to police in the days following the murder. He later pleaded guilty to second-degree murder and in February was sentenced to 17 to 28 years in prison.

Bashara is already serving a sentence of 80 months to 20 years after admitting he tried to have Gentz killed last June while Gentz was housed in a Wayne County Jail facility.

Jane Bashara, a Mount Clemens native, was married to Bob Bashara for more than 20 years, and the couple had two grown children. She most recently worked as a marketing manager for an energy consulting company in Detroit after working for Detroit Edison for 25 years.

Bob Bashara, the Grosse Pointe Park man accused in his wife’s death, is scheduled to have a preliminary exam in August.

A scheduling conference was held today in Detroit’s 36th District Court, and the preliminary exam was set for Aug. 19.

Bashara is charged with first-degree murder, conspiracy to commit murder, solicitation to commit murder, suborning of perjury during a capital trial, witness intimidation and obstruction of justice in connection with Jane Bashara’s death in January 2012.

Bashara, who said during his arraignment earlier this month that he was trying to raise funds for an attorney, was represented in court today by court-appointed attorney Mark Procida.

Procida, who said he has met with Bashara, said there is so much discovery in the case “it’s going to take months to sift through it.”

Maria Miller, a spokeswoman for the Wayne County Prosecutor’s Office, said the August preliminary exam date was set to give the parties time to prepare “because the discovery materials in the case are so extensive.”

When announcing charges against Bashara last month, Wayne County Prosecutor Kym Worthy said the investigation into Jane Bashara’s death includes 5,000 pages of documents and involves nearly 300 witnesses.

Bashara is serving about 6 1/2 to 20 years in prison after pleading guilty to solicitation of murder for trying to hire a hit man to kill his former handyman, Joseph Gentz, who told police he killed Jane Bashara at her husband's direction. Bashara admitted he tried to pay a local business owner to find someone to kill Gentz, who was sentenced to 17-28 years in prison in Jane Bashara‘s death

Jane Bashara was found strangled in her SUV, which had been dumped in an alley on Detroit's east side.

The Grosse Pointe Park man already serving a prison sentence will not appear in 36th District Court on charges related to his wife's 2012 strangulation death until late August.

Bob Bashara had been scheduled to have a preliminary exam Tuesday in 36th District Court but the hearing was rescheduled for Aug. 19 after officials reached an agreement, according to Wayne County Prosecutor's spokeswoman Maria Miller.

Bashara was arraigned last week on murder and five other charges related to the January 2012 strangulation death of his wife, Jane Bashara. The charges were announced about 15 months after her body was found in the backseat of her SUV in Detroit.

Jane Bashara's death was ruled a homicide shortly thereafter, and the investigation into her death was been ongoing by the Wayne County Prosecutor's office since.

Bob Bashara is charged with:

• first-degree murder
• conspiracy to commit first-degree murder
• solicitation to commit murder
• suborning of perjury during a capital trial
• witness intimidation
• obstruction of justice


If convicted, Bashara faces mandatory life in prison on the first-degree murder charge; up to life on each the conspiracy, solicitation and suborning counts; 15 years for witness intimidation; and five years for obstruction of justice.

Last week Bashara had asked to have the preliminary exam date farther into the future, explaining he wanted to have a chance to raise funds to hire an attorney. The judge denied setting the date any later than Tuesday, explaining if necessary he would be appointed an attorney if he did not have one by Tuesday.

The original hearing was scheduled at 1:30 p.m. That was changed to a schedule conference hearing at 9 a.m., during which he was not to appear in person.

Following the morning hearing, Miller said, "the preliminary examination was adjourned by agreement of the parties until August 19, 2013, at 9:00 a.m. in 36th District Court in Detroit."

The preliminary exam is a hearing for the judge to determine whether sufficient evidence exists and whether the prosecutor's may proceed with the case. Generally, that hearing is scheduled within 14 days of the arraignment unless the accused waives their right to have it in that timeframe.

Bashara is already serving a prison sentence on a second, related case involving his former handyman, Joe Gentz, whom he tried to have killed while in jail to prevent him from testifying. Bashara is currently being housed in Manistee in Oaks Correctional Facility.

Gentz is serving 17 to 28 years in prison for his role in Jane Bashara's death. He is among the nearly 300 witnesses in the case.

May is sweeps month when TV ratings help set advertising rates.

So what better way to tweak the ratings than to take a little tour of murder suspect Bob Bashara's much-talked about sex dungeon.

WDIV on Sunday night aired a segment with reporter Hank Winshester taking a tour of Bashara's dungeon in a Grosse Pointe Park building he owns.

WInshester notes that dungeon still has many of the fixtures: A bed, sword, rope, hooks and " adult toys we can't show you on TV."

A legal expert tells Winchester he expects prosecutors to bring up the dungeon during Bashara's murder trial to show motive for wanting to kill his wife. Bashara is accused of hiring handyman Joe Gentz to kill his wife Jane.

A woman named Lynn, a former mistress of Bashara's who spent time in the dungeon and is cooperating with investigators, revisits the private lair with WDIV.

A Grosse Pointe Park building owned by Bob Bashara at the time of his wife's 2012 murder now is for sale.

The building is almost empty since most of the tenants have taken off, but what's still hidden inside likely will play a key role in the case against Bob Bashara.

A door to the basement leads to his secret sex dungeon. For the first time, cameras have captured what is in the space. To the Local 4 Defenders' surprise, the dungeon that made headlines and that Bashara denied existed is still stocked.

There is a bed in the corner, and ax on the floor and up on the wall is a sword. A mirror looks down on the bed.

Hooks in the room were used with rope to tie up people in the dungeon. There is a motorized device on the floor.

Then there is a cabinet filled with rope, candles and adult items.

A woman named Lynn spent time with Bashara in his dungeon. She also went to police when she saw him on TV after the news broke about his wife's murder.

Lynn went back into the dungeon last week with an undercover Local 4 producer and hidden cameras.

"There were no windows. It was dark. But even when I was in there it was lighted with lamps," said Lynn. "But there were like medieval time lighting fixtures as well."

According to the Wayne County Prosecutor's Office, Bashara has worked to get witnesses to lie and to help hide key parts of information. However, he has shockingly left the dungeon in tact. The whips, chains and toys are all still there in the basement behind a locked door.

It will all play a role in the murder trial.

"There is probably a lot of great circumstantial evidence in the case. Why would it be relevant as it relates to anything that Bob has done is probably more about motive and why he wanted to kill his wife," said legal expert Todd Flood.

DETROIT — Grosse Pointe Park's Bob Bashara is on trial for the murder of his wife, 56-year-old Jane Bashara in January of 2012, and it will be the public who pays his attorney fees.

Bashara was represented by a public defender this week when he appeared for a preliminary examination that was adjourned until Aug. 19.

The 1963 Supreme Court ruling in "Gideon v. Wainwright" created the standard that defense attorneys should be provided to defendants who cannot afford one at the public's expense.

Bashara, once a well-off property investor and landlord, is now indigent, the Wayne County court system has determined.

Representatives in the Wayne County Third Circuit Court Criminal Division said they were unable to answer question related to public defenders, their pay rates and criteria for appointment, and referred questions to the law group that coordinates the attorneys.

MLive could not reach representatives there as of 8:45 a.m. Wednesday.

Bob Toole wonders if he was the last person to see his Grosse Pointe Park neighbor alive.

Police are calling the death of the 35-year-old woman suspicious but have released no details about what may have happened. Toole said the woman lived with her boyfriend on the first floor of a duplex in the 1300 block of Wayburn, where police answered a 911 call and found her deceased at about 12:11 a.m. today.

The woman’s name has not been released.

Toole, whose home is behind the woman’s house, said he saw her standing in a concrete area behind her home Wednesday evening staring at flats of pansies that were to be planted in a small garden. She was still wearing the scrubs from her job at Platz Animal Hospital on Mack Avenue where she worked.

Toole, 46, said he walked to a store, and when he returned about 30 minutes later, she was gone. He noted that it was odd that she was not outside on a nice night and that the main rear door had been left open. He and others were questioned by police this morning. One neighbor had heard a door slam in the evening but otherwise noticed nothing unusual. Toole said the woman's boyfriend works evenings at a nearby bar.

Toole said he feels bad for the woman’s mother and her boyfriend, whom he said adored her.

She was a “nice, calm, quiet person. Kept to herself. Hopefully she’s in a better place now,” Toole said.

The Michigan State Police Sterling Heights crime lab, the Wayne County Medical Examiner's Office and the Wayne County Prosecutor's Office are assisting the Grosse Pointe Park Pubilc Safety Department in the investigation. Messages seeking additional information have been left for Public Safety Director David Hiller.

The duplex is located less than two blocks from the rental where handyman Joseph Gentz lived. Gentz is serving a 17-28 year sentence in the slaying of Jane Bashara. Gentz said he killed the Grosse Pointe Park woman at the behest of Bashara’s husband, Bob, who is now charged in the January 2012 death as well.

This afternoon, a few TV news vans were parked near the duplex, and at least one officer was working inside. The officer declined to answer questions from reporters as he headed to his car.

A few houses away, Loren Andersen, 24, stood with other neighbors. Andersen used to to work with the woman at the animal hospital. She said the woman could always make her laugh and loved cats.

“She was a very good friend of mine, and ... when I found out, I couldn’t believe it,” Andersen said. “She’s got so many friends, so many loved ones. It’s just, it’s really hard to say that she’s gone.”

GROSSE POINTE PARK (WWJ) – Linked to a notorious murder, Bob Bashara’s Grosse Pointe Park home has been sold.

Bashara, who’s charged in his wife’s, was given until May 15 to come up with $64,000 to stop the sale. He didn’t have the cash — and the deal closed on Tuesday.

Bashara is currently behind bars, serving a 20-year sentence for paying his former handyman, Joseph Gentz, to kill his wife, Jane, in the garage last year.

The 2,800 square-foot home on Middlesex has five bedrooms, three full bathrooms, two half-baths, a remodeled kitchen, finished basement and wine cellar. It went on the market for $415,000.

WWJ Newsradio 950′s Mike Cambell reported he could smell the fumes from fresh paint when he stopped by on Friday.

The new resident told Campbell said there’s nothing creepy about the home; he got a good deal on it and his family likes the location. The man, who didn’t want to give his name, added: ”The house didn’t kill anyone.”

The case has drawn national attention with tales that Bashara secretly ran a sex dungeon in the basement of one of his businesses and was known in chat rooms and at S&M parties as “Master Bob. “

Bashara’s preliminary hearing is scheduled for Aug. 19 in 36th District Court in Detroit.

GROSSE POINTE PARK, Mich. -
According to the Wayne County Medical Examiner's Office, 35-year-old Sabrina Gianino, who was found dead Thursday morning in her Grosse Pointe Park home, was strangled to death.

Police said a 911 call came in just after midnight and officers found Gianino in a home in the 1300 block of Wayburn Street. Police reportedly got the call from Gianino's boyfriend. He was questioned by police and released.

Police are calling the death suspicious but are not discussing any possibility of forced entry. Sources say markings were found around Gianino's neck.

An autopsy revealed Friday that it was death by strangulation.

Shot fired at St. Clair Shores church festival

Someone fired at least one gunshot into the air late Saturday as a church festival in St. Clair Shores was closing for the night, sending hundreds of people scurrying for cover, according to police and a church official.

The incident happened about 11:10 p.m. as workers were shutting down the midway of the annual St. Joan of Arc Festival on Overlake at Greater Mack. No one was reported to be hurt and police are conducting an investigation.

The St. Joan of Arc Festival each spring draws thousands of people to the church campus for midway rides, food and entertainment. Church officials said the shooting did not impact Sunday’s attendance as large crowds turned out on a warm spring afternoon to enjoy the final day of the three-day event.

The spring festival was in the headlines last year when Grosse Pointe Park murder suspect Bob Bashara was asked to leave after he inexplicably showed up to work as a volunteer in the Vegas tent.

At the time, he was considered a person of interest in the strangulation of his wife, Jane Bashara. Now accused in his wife’s death, he is serving a six-to-20 year prison sentence after trying to hire a hit man to kill Joe Gentz, who has confessed to killing Mrs. Bashara at Bob Bashara’s behest.

“I guess there’s always some excitement at our festival,” Bugarin said.

Kayla Bentley was thrilled to move into her in-laws’ house as a 19-year-old newlywed back in 2010.

That is until she found out that the unassuming house on a quiet street in Allen Park was where Justin Olszowy, a mentally unstable 26-year-old man, fatally shot his parents two years earlier.

“We were kind of upset about it,” she recalled. “It freaks me out, especially because in this situation, he’s not dead. If he was released or escaped, this is where he’d come.”

But her in-laws, retirees Paula and Jerry Bentley, had fallen in love with the house — three bedrooms, full-size kitchen, nice living room, privacy fencing, a garage, a corner lot.

Location, location, location may be the adage, but what happens when that location is the site of a violent death?

Properties that were the sites of homicides or suicides have an interesting stain that remains long after crime-scene investigators leave. For some potential buyers, owning a home with notoriety gives them, well, notoriety. Others are freaked out by it.

In short: I see dead people — and lovely crown moldings.

“One group says, ‘I don’t want to have anything to do it.’ Another group says, ‘I’ll get the carpets cleaned. How much can I buy it for?’ ” explained Jason Abrams, owner of the Abrams Team based out of Keller Williams in West Bloomfield and star of HGTV’s “Scoring the Deal.”

Under Michigan law, real estate agents aren’t obligated to disclose whether the property was or was suspected to have been the site of a homicide, suicide or illegal activity “which had no material effect on the condition of the real property or improvements located on the real property.”

Although sellers don’t have to fill you in on any ghoulish details, they do have to confess to a leaky basement or roof or whether the insulation is made from toxic materials, such as formaldehyde.

However, elsewhere in the country, some states, such as California, require would-be buyers to be told. (In the Golden State, that’s spawned a micro-industry of home cleansers who remove spirits from homes.)

“On the seller’s disclosure form, there’s nothing that says, ‘Has there been a murder? Has there been a ghost?,’ ” said Michelle R. E. Donovan, a Bloomfield Hills real-estate attorney. “You don’t want to fail to disclose something that would influence the buyer’s decision to not purchase the property.”

Donovan, whose former home in Clinton Township was down the street from where a man fatally stabbed his wife, said someone who buys a so-called stigmatized property might try to sue under misrepresentation or fraud.

For higher-profile killings — like Jane Bashara’s, reportedly in the Grosse Pointe Park home she shared with her husband, Bob, now charged with killing her — buyers know what they’re getting into, but that doesn’t mean it’s very easy for the Realtor selling it.

“Obviously it’s not like any other house, when you have a distressed property, said Janis Chiapparo of II Elite Real Estate in Roseville, the real estate agent who sold the Bashara house. “The house was innocent ... Grosse Pointe is full of homes people have died in. Maybe not in that manner.”

Chiapparo wouldn’t say how much it sold for, only that it was less than the listing price of $415,000.

“Buyers obviously are going to want a steal. They think they’re going to get the price cheaper or they stay away from it,” she said.

That’s what happened with the Bentleys. Kayla said the family believes in ghosts, but the issue was more about the cash than Casper. They got it for less than $70,000.

“They talked the people down, because it had been empty for two years. Obviously, no one wanted to buy it,” said Kayla Bentley, who admitted that her husband, Joshua, slept with a baseball bat at his bedside for part of the two years they lived with his parents.

Disclosure posed a dilemma for Mario Como, the broker-owner of St. Clair Shores-based Realty Executives Select, a few years ago when showing a house in that community that he suspected someone had committed suicide in.

“I knew that would only cause the client emotional conflict. On one hand, they were excited about the property and on the other hand, it was giving them an opportunity to pass on the property,” he said. “I was definitely torn. I have certain duties as an agent of client or buyer, but ultimately, one of my duties is to help them reach their goals. In this case, the goal was very clear: a home they were very, very enthusiastic about.”

Abrams said he thinks sharing a house’s violent past is the way to go. He never has sold a home in Michigan that was the site of a homicide or suicide, but he has elsewhere in the U.S.

“The more information a buyer can have, the better off a buyer is. If you’re going to be a state that’s really serious about consumer protection, the idea should be always disclose,” he said. Death “weeds people out. Death is that topic that universally makes people squeamish and it ends up being a focal point, no matter how beautiful the home is.”

David Griem, a high-profile attorney whose clients have included murder suspects Bob Bashara and Stephen Grant, was appointed Warren’s new city attorney by Mayor Jim Fouts.
 
Griem is to replace James Biernat, a retired Macomb County Circuit Court judge, who is resigning from the city post, Fouts said in a release today.
 
Fouts is urging City Council to confirm Griem’s appointment.
 
Griem was born and raised in Warren and served as the city’s attorney in the 1980s, according to a release from Fouts’ office. Griem has conducted over 200 criminal and civil jury trials, according to his resume, and also has represented large corporations.
 
“Griem’s government and private experience will be a tremendous asset to our legal department and the city as a whole,” Fouts said.
 
A graduate of Michigan State University and Detroit College of Law at Michigan State University, Griem was an assistant prosecutor and later principal trial attorney in Macomb County in the 1970s and an assistant U.S. attorney in 1980.
 
He has been practicing law for more than 30 years and has represented high-profile suspects from police officers to a mafia boss, often winning acquittals, dismissals or lesser charges for clients.
 
He most recently represented Bashara, a Grosse Pointe Park businessman accused in the strangulation death of his wife, Jane Bashara, in January 2012. Nearly a year ago, Griem asked to withdraw as Bob Bashara’s lawyer, citing an irreparable breakdown in the attorney-client relationship.
 
Griem was ordered to pay $8,000 in attorney and court fees in November after being found in civil contempt of court. He was accused of improperly sharing evidence with Bashara’s family and sending a subpoena to a company seeking work records for Joseph Gentz, a handyman who told investigators he killed Jane Bashara at her husband’s direction.
 
Griem also said he issued a subpoena seeking Jana Bashara’s cell phone records, but later rescinded the subpoena. A 36th District Court judge said up to the point of the charges, Griem had an “impeccable” record.
 
Griem also initially represented Grant in the killing and dismemberment of his wife, Tara Grant, in 2007 in Macomb County. Griem publicly dropped Stephen Grant as a client after Grant fled the area as investigators found part of his wife’s body in the family garage. Grant was convicted of second-degree murder.

Well-known criminal defense lawyer David Griem has been appointed as Warren’s new city attorney.

The appointment, announced Wednesday by Mayor James Fouts and subject to confirmation by the Warren City Council, brings Griem back to the city’s in-house legal staff where he worked in the 1980s.

“Griem’s government and private experience will be a tremendous asset to our legal department and the city as a whole,” Fouts said. “I strongly urge City Council confirmation of this important appointment.”

Griem declined to comment, saying he prefers to wait for the confirmation hearing, tentatively scheduled for June 25.
He has been an attorney for 40 years. Before his first stint as city attorney, he was a principal trial attorney in the Macomb County Prosecutor’s Office and then worked as chief federal prosecutor at the U.S. Attorney’s Office for the Eastern District of Michigan.
 
As a criminal defense attorney, he has handled several high-profile cases. The case which drew the most publicity was that of Stephen Grant, the Washington Township father accused of killing and dismembering his wife, Tara Grant.
 
Griem also represented Bob Bashara, the Grosse Pointe Park man charged with hiring a hit man to kill his wife, Jane.

David Griem picked to become Warren city attorney

WARREN — Mayor Jim Fouts has nominated high-profile lawyer David Griem to become Warren’s new city attorney.
 
The move comes with the pending departure of Judge James Biernat, who has led the city’s Legal Department since January 2011 but this year informed the mayor of his intention to resign.
 
Fouts announced Griem’s nomination June 12 and said he planned to send his pick to the Warren City Council for consideration later this month.
 
Griem declined an opportunity to comment on the nomination ahead of the mayor’s formal request before the City Council, which was expected to appear on the June 25 meeting agenda. He did, however, address the opportunity in a letter to both Fouts and members of the council.
 
“I fully expect to work many more hours over and above the normal work day schedule,” Griem said in the letter. “I have been doing that throughout my entire professional career.”
 
He also wrote, “My family roots are in Warren. I feel great affection for this city in which I was born, raised and attended high school. I look forward to coming back and doing everything within my power to see that the city of Warren receives the best possible legal services at a reasonable price.”
 
Griem has worked as a prosecutor at both the county and federal levels. He briefly served as Warren’s city attorney under Mayor James Randlett in the early 1980s.
 
As an attorney in private practice for more than 30 years — specializing in criminal and civil litigation, according to his bio — Griem represented defendants in many high-profile cases, such as Stephen Grant and Bob Bashara. Griem also defended former Warren City Council President Chuck Busse, who was acquitted of federal public corruption charges in 2003.
 
Fouts said Griem is “one of the top attorneys in the United States” who is coming back to his roots in Warren, seeking a challenge.
 
“He grew up in Warren. He’s a hometown boy,” Fouts said. “He’s his own person. He’s very strong-willed. I think we’re going to get a pretty good deal for the money.”
 
The salary for Warren’s city attorney was $112,117 last year, according to the adopted budget.
 
In 2010, Biernat opted not to seek re-election as a judge of the Macomb County Circuit Court prior to his nomination as Warren’s city attorney. Fouts called Biernat, “a person of high ethical standard.”
 
“Unquestioned ethics, and a real decent human being,” Fouts said. “Someone who is a good example of the public trust.”
